Terms of Service
These terms govern your use of DxCISION. By creating an account or using the service, you agree to them.
1. About DxCISION
DxCISION provides structured clinical decision support for licensed healthcare professionals. It is not a medical device substitute for independent professional judgment and does not establish a doctor–patient relationship between DxCISION and any person you treat.
2. Eligibility
- You must be a licensed clinician eligible to practice under the Medical and Dental Council of Nigeria (MDCN) or equivalent authority in your jurisdiction.
- You must register with a valid MDCN folio in the format required at sign-up.
- You must be at least 18 years old.
- You may not use DxCISION if you are barred from clinical practice or if your account has been suspended.
3. Clinical disclaimer
DxCISION supports your reasoning. It does not replace it.
- All outputs are suggestions for structured thinking — not definitive diagnoses, prescriptions, or treatment orders.
- You are solely responsible for clinical decisions, documentation, and patient care.
- Verify every recommendation against the patient, your examination, local protocols, and senior guidance before acting.
- In life-threatening emergencies, initiate immediate hands-on care. Do not delay treatment to wait for software output.
- AI-generated content may be incomplete, outdated, or incorrect. DxCISION includes safety checks but cannot guarantee error-free output.
4. Your account
- You are responsible for safeguarding your login credentials.
- You must provide accurate registration information and keep it current.
- You must notify us promptly at support@dxcision.com if you suspect unauthorized access.
- One account per clinician. You may not share credentials or resell access.
5. Acceptable use
You agree not to:
- Use DxCISION for non-clinical, fraudulent, or unlawful purposes
- Submit content you do not have rights to use, or that violates patient confidentiality obligations
- Attempt to reverse engineer, scrape, overload, or disrupt the service
- Circumvent usage limits, authentication, or safety controls
- Present DxCISION output as autonomous medical advice to patients or the public
Enter de-identified clinical information wherever possible. You remain responsible for compliance with professional confidentiality duties and applicable health data laws.
6. Intellectual property
DxCISION, its branding, software, and documentation are owned by us or our licensors. We grant you a limited, non-exclusive, revocable license to use the service for your professional clinical workflow.
You retain ownership of case content you enter. You grant us a license to process that content solely to operate and improve the service, as described in our Privacy Policy.
7. Service availability and changes
We strive for reliable availability but do not guarantee uninterrupted access. Features, usage limits, and pricing may change — including free and paid tiers during early access. We will provide reasonable notice of material changes where practicable.
8. Limitation of liability
To the fullest extent permitted by law, DxCISION and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for any harm arising from clinical decisions you make based on service output.
Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve (12) months before the claim, or zero if you used a free tier.
9. Indemnity
You agree to indemnify and hold harmless DxCISION from claims arising from your misuse of the service, breach of these terms, or violation of applicable law or professional obligations.
10. Termination
You may stop using DxCISION at any time. We may suspend or terminate access if you violate these terms, pose a security or safety risk, or if we discontinue the service. Provisions that by nature should survive termination (including disclaimers and liability limits) will survive.
11. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of courts in Nigeria, unless mandatory law requires otherwise.
